Terms of Service

These terms apply to the use of ProcessMap AI (the "Service"), provided by Han Yu, Krankenhausstraße 8, 93449 Waldmünchen, Germany ("we"). By using the Service you agree to them.

1. Who can use the Service

The Service is offered to businesses and professionals acting in their commercial or self-employed capacity (§ 14 BGB). It is not offered to consumers.

2. The Service

ProcessMap AI helps you run requirements interviews and turns them into process maps, data flow diagrams, entity-relationship diagrams and requirements specs. The Service is in early access: features can change, and we will tell you in advance about changes that materially affect your plan.

3. Plans, trials and payment

Plans, prices and included interviews are listed on the pricing page. Pro and Team include a 14-day free trial. During early access, we set up trials and plans by email. Paid plans renew automatically each month or year until cancelled. We will tell you which payment provider processes your payment before you are first charged; taxes are added as required by law.

4. Your content

You keep all rights to the interviews, documents and models you create ("Customer Content"). You give us the right to process Customer Content only as needed to provide the Service. You are responsible for having a legal basis to record and process the interviews you run, including informing and, where required, obtaining the consent of interviewees.

5. Confidentiality

We treat Customer Content as confidential and do not disclose it to third parties, except to the service providers listed in our privacy policy that we use to run the Service, or where the law requires it.

6. Acceptable use

You must not use the Service to break the law, infringe the rights of others, or interfere with the Service or its security.

7. Availability

We aim to keep the Service available but, during early access, do not guarantee a particular uptime.

8. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breaches of essential contractual obligations, limited to the damage typically foreseeable when the contract was made. Liability under the Product Liability Act remains unaffected.

9. Term and termination

You can cancel at any time with effect from the end of the current billing period, as described in the refund and cancellation policy. We can terminate for good cause, for example serious breaches of these terms.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, the place of jurisdiction is our place of business.
